Invest in Oman Portal is a website where different stakeholders can register themselves with the common motive of Investing in Oman. It is used to establish a connection with validated Stakeholders for the various business opportunities in Oman in different Sectors and subsectors of the country. Invest in Oman Portal is fully owned by Ministry of Commerce, Industry & Investment Promotion (MoCIIP). Usage of Invest in Oman Portal services by registered users, online or offline, is governed by the following Terms and Conditions.

By registering as an Investor/Project Owner/Service Provider on Invest in Oman Portal, the user hereby agrees to have fully read and understood the below Terms and Conditions. Further, users also agree that the company which the user is representing, and all legal representatives of user’s company have perused this Terms and Conditions, understood it, and fully accept to be bound by this Terms and Conditions.

Definitions

Invest Oman center is a center affiliated with the Ministry of Commerce, Industry and Investment Promotion (MoCIIP) concerned with attracting investment and communicating with stakeholders accredited to various business opportunities in the Sultanate of Oman in various sectors and sub-sectors and facilitating all their investment procedures.
"Portal" or “Website” refers to the Invest in Oman Portal that is accessible through a functional online access system.
“Center” refers to the Invest Oman Center that affiliated with the Ministry of Commerce, Industry and Investment Promotion.
"Service" or "Services" means the functionalities provided through Invest in Oman Portal offered by Invest Oman Center on the Portal, subject to utilization policies prevailing on the Portal.
"Register" means the free or paid facility given to the Companies who wish to use the mentioned Services from the Invest in Oman Portal for a specific period.
"You" and "User", "Investor", “Project Owner” and “Service Provider” as used herein refer to all individuals and/or the Company accessing this website for valid business reason.
"Company" unless specified otherwise, means the juristic entity which the User represents.
"Material" means text, graphics, images, documents and any other viewable item or contents of the Service.

General Terms

By registering as User, on the Invest in Oman Portal, you accept all Terms and Conditions.

Users who complete the Registration Process on Invest in Oman Portal are offered access to the relevant Services of Invest in Oman Portal which begins from the date of issuing the username and password and remains valid until otherwise explicitly informed to the User by Invest Oman Center.

Invest Oman Center reserves the right, in its sole discretion and at any time, to make changes to the Terms and Conditions.

Invest Oman Center also reserves the right, to waive or modify any of the clauses in the Terms and Conditions, at any time, if they apply to a specific item of the User, without affecting the application of the terms to any other Users.

Any changes made will be effective accordingly when made and the updated Terms and Conditions will be available on Invest in Oman Portal.

If Invest Oman Center consider that any provision of the Terms and Conditions as invalid, void or for any other reason unenforceable, that provision shall be deemed severable as an update to the Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions.

You understand and agree that Invest Oman Center may send you certain communication in connection with the Services, such as service announcements and administrative messages, and that Invest Oman Center may also send you copies of any periodic newsletters or similar informative communications from time to time.

Any notifications sent to you by Invest Oman Center, concerning the Services or related matters are intended to the User and not intended to be made public.

While Invest Oman Center makes reasonable efforts to ensure that the Services are always available, Invest Oman Center does not guarantee that the Services will be uninterrupted or error-free, and Invest Oman Center does not guarantee that Users will always be able to access or use all the Services or all their features. Users agree that they utilize the Services at their own risk Invest Oman Center may change, suspend or discontinue any (or all) Services, or any of their features, at any time, and Invest Oman Center may also impose limits on the use of or access to certain features or portions of the Services, or restrict your access to any part or all of the Services, in all cases without notice to you or liability to Invest Oman Center.

The information that you supply during the registration process is deemed accurate and complete by Invest Oman Center. Invest Oman Center, at its sole discretion, may suspend or delete the record of a User if the record is considered incomplete or out-of-date as assessed against Invest Oman Center

The confidentiality of your login id and password is your responsibility. Invest Oman Center disclaims any responsibility or liability arising from your disclosure of any information, in the Services.

Invest Oman Center is not under any obligation to do so but may monitor certain User activities.

Invest Oman Center reserves the right to review all users to remove or to refuse to display, any Users in Invest Oman Center

Invest Oman Center does not make any promises as to what actions Invest Oman Center will or will not take concerning any User who violates the Terms and Conditions and no such promises should be inferred from either the Terms and Conditions or any communication by Invest Oman Center. Invest Oman Center does not endorse or guarantee the accuracy of any User information and You agree that Invest Oman Center shall not be held responsible for the accuracy of the Users

Further, all Users shall abide by laws prevailing in the Sultanate of Oman or any other International Laws and Regulations that apply.

As part of its Services, Invest Oman Center connects with external source feeds from various entities, such external sources are not controlled by Invest Oman Center and no representation is made by Invest Oman Center as to their content.

Invest Oman Center makes no representations or warranties concerning the accuracy of the information supplied by the User or the delivery or transmission of the Service.

Invest Oman Center disclaims any responsibility or liability for the conduct of Users or any obligations arising whether directly or indirectly from Registration and Participation, in any procurement/auction events, including claims for damages and/or for any indemnification whatsoever.

Invest Oman Center shall be indemnified from any claims arising out of any kind of loss from anyone using the services of Invest Oman Center.

User agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of or any transactions or activities being conducted on and during the usage of the system.

Services Term

Any or all the Services are given on the Portal may be chargeable as per the policies of Invest Oman Center and MoCIIP.

Users agree to use the System in accordance with the Terms and Conditions and warrant the accuracy of the information supplied to Invest Oman Center and agree to the best of their abilities to answer the questions in the questionnaires as accurately and completely as possible so that the information reflects the status of their company and the specific opportunities and services offered by them at the time of completion of any questionnaires, and thereafter to utilize the System and its Services to update their record in a timely manner whenever there is a change in the aforementioned information. You agree not to attempt to influence or impede any activities in any way and that you will comply with all the requirements as laid by Invest Oman Center.

You fully authorise Invest Oman Center to access your data and information submitted by your company online and offline as part of the validation process.

You also agree to host the validated data on our website Invest in Oman Portal for access by Investor/Project Owner/Service Provider who connects on Invest in Oman Portal for their related usage.

Regardless of whether an investment is successful or unsuccessful or the Process is terminated, all costs, charges and expenses incurred by User in the preparation and submission of the investment or Alternative requirement, including visit program, shall be borne by User.

Any or all the Services may have additional Terms & Conditions relevant to that Services which will not cancel any or all the terms described herein unless it is explicitly mentioned by Invest Oman Center.

Invest Oman Center while taking all possible steps to ensure confidentiality of your data does not guarantee in any way that the data will remain secure and confidential on the Portal.

You agree to manage your data responsibly and ensure compliance with the requirements as laid by Invest Oman Center.

In searching the Services, you shall not employ any automated search tools, which include - crawlers, bots and/or spiders - that programmatically access and extract content in order to repurpose/resell the Services content and tools, nor may you ‘scrape’ and/or reformat any information off the services.

Privacy Of User Information

The services and the tools/content/material/information found on the services are solely for lawful use. You shall not upload to, distribute to or through, or otherwise disseminate through the Service any material or information of any kind that is libellous, defamatory, obscene, pornographic, abusive, or in any case violate any law/infringement or violate any privacy or the rights of any other person or entity, or contains a solicitation of funds, advertising, or a solicitation for goods or services.

Invest Oman Center has no obligation to, and does not and cannot, review every item of material or information that you and users other than you make available through the Services, and Invest Oman Center is not responsible for any content of this material or information.

However, Invest Oman Center reserves the right to delete, move, or edit any material or information that it deems, in its sole discretion, unacceptable, libellous, defamatory, obscene, pornographic, abusive, or otherwise in violation of any law or that infringes any privacy or the right of any person or entity.

Further, Invest Oman Center always reserves the right to disclose any material or information as necessary to satisfy any law, regulation, or governmental request.

Violations

Violations of system and network security of the Portal are prohibited and may result in criminal and civil liability. Examples of Invest Oman Center system and Invest Oman Center network security violations include the following:  Any automated use of the system.

 Use of any software that allows your account to remain logged-on while you are not actively using the account.

 Unauthorized access to or use of data hosted on the Portal, systems or networks, including any attempt to probe, scan or test the vulnerability of the system or network/to breach security/authentication measures without the express authorization of the owner of the system or network.

Users not allowed to download or upload files that contain data, software, materials or information that are not owned by them and for which they do not have a license.

Users not allowed to upload or download files that contains malicious software, corrupted data or viruses.

Users not allowed to publish or advertise information that contains defamation or violation of regulations.

Invest Oman Center may investigate an incident involving such violations, any violations of the Terms and Conditions that may constitute or have the potential to constitute violations of law and any activity by Members on the network that constitute or may constitute violations of law.

You understand that we may report any such activity to, and cooperate with, law enforcement, or another legal process.

Everything that is considered in violation of the Anti-Cyber and Information Technology Crimes Laws or a related issue in the Sultanate of Oman.

Secure Attachment Policy

The attachments uploaded on the Invest in Oman Portal are subject to the Secure Attachment Policy.

The Secure Attachment Policy is set to protect users from malicious files and attachments. Certain attachments containing executable/ program files may have destructive programs or malicious functions which perform phishing/ spamming/ malicious activities in the user’s system and may even misuse the user’s identity.

Hence to avoid such security threats certain file attachments are blocked in our Portal. The attachment types that are blocked by this policy include: ade, adp, bat, chm, cmd, com, cpl, exe, hta, ins, isp, jar, jse, lib, lnk, mde, msc, msp, mst, pif, scr, sct, shb, sys, vb, vbe, vbs, vxd, wsc, wsf, and wsh.

Termination of Registration

Your Registration will be revoked if you fail to abide by the Terms and Conditions.

In such an event, you agree not to re-register as a User/User of Invest Oman Center network.

Invest Oman Center reserves the right to disable or terminate a User if it is a period of inactivity.

Users have the right to terminate this Registration on Invest in Oman Portal at any time.

If your Registration is terminated or deactivated, your name and all information uploaded by you including any or all information available on your pages will be permanently deleted.

Damages & Indemnification

You agree that you will be responsible for any violation of the Terms and Conditions.

You further agree to indemnify and hold Invest Oman Center and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys

Disclaimer Of Liability

Invest Oman Center shall have no liability regarding any Services provided, or to be provided.

All Users are independent contractors and not employees, partners or joint venture partners with Invest Oman Center.

Invest Oman Center shall have no liability regarding any benefits provided, or to be provided, by any Users.

General Release

Each Users, hereby forever releases, acquits and discharges MoCIIP from any and all liabilities, claims, demands, actions and causes of action that such Users or such User.

Governing Law

The Terms and Conditions and the respective rights and obligations of the parties hereunder shall be governed by and construed in accordance with the laws of Sultanate of Oman.

Any dispute arising between the Users and Invest Oman Center will be settled amicably between the parties, failure to reach an amicable settlement, the matter will be submitted to arbitration following the laws of Sultanate of Oman.

You agree that, unless expressly waived by MoCIIP, an action in a different jurisdiction can be taken by MoCIIP, the exclusive jurisdiction for any claim or action arising out of or relating to this Terms and Conditions.

By using the website, you, as the user, agree to the practices set out in this statement.
